Ouch... Leftist call for deeper investigation of Clinton slush fund (er..foundation)

MrMike

Bless you all
Apparently Robert Reich (not a righty) and Common-Cause (a lefty organization) have seen enough of the Clinton cash shenanigans and is calling them out on it. I agree...

Time for an independent audit of the Clinton Foundation, says … Common Cause

Will the Left circle its wagons around the Clintons, or ride off into the sunset without them? The Clinton Foundation announced this week that they would conduct a voluntary internal audit after the exposure of their failure to properly declare millions of dollars from foreign governments to the IRS. A leading progressive group, Common Cause, says that’s not good enough (via Instapundit and the Washington Examiner):

Citing concerns about potential conflicts of interest and the influence of hidden overseas donors, Common Cause called on presidential candidate Hillary Rodham Clinton and the Clinton Foundation today to commission an independent and thorough review of all large donations to the foundation and to release the results.

“As Mrs. Clinton herself observed earlier this week, voluntary disclosure is not enough,” said Common Cause President Miles Rapoport. “A report in Thursday’s New York Times indicates that the Clinton Foundation violated an agreement to identify all of its donors. The foundation’s omissions create significant gaps in the information that voters need to make informed decisions at the polls.”

To ensure that the audit is complete, Rapoport said the foundation should enter into a contractual agreement with auditors to open its books fully and to make public the complete report of their review.

In the meantime, Common Cause wants the Clintons to stop taking cash from foreign governments and corporations, which would mean shutting down entirely:

And to further guard against potential conflicts of interest, the foundation should stop accepting donations from foreign governments and foreign corporations, he said.

That puts Common Cause on the same side as … Ted Cruz. Cruz went a little farther and demanded that the Clinton Foundation return all of the cash they’ve received from foreign governments:

Sen. Ted Cruz (R-Texas) is calling for his potential 2016 foe Hillary Clinton to return all donations made to the Clinton Foundation by foreign governments, as criticism stemming from a new book continues to mount.

“The Clinton Foundation collected tens of millions of dollars from foreign governments including donors who had business interests with the State Department while Clinton was Secretary. She made decisions in that capacity that likely benefited the same people who were giving large donations to the foundation,” Cruz said Friday in a statement.

“At the very least, these revelations present a clear conflict of interest. I call on Hillary Clinton to return the donations from foreign governments. Until she does, how can the American people trust her with another position of power?”

Talk about strange bedfellows, eh?

This goes somewhat outside Common Cause’s usual political portfolio. As of this morning, the top featured stories on their banner carousel were:

  • ALEC tries to silence Common Cause!
  • Tell Pfizer: Just say no to ALEC!
  • Tell the FEC: Investigate these “non-candidates” [picturing Jeb Bush and Scott Walker]
  • Don’t let Congress block Net Neutrality
  • Tell President Obama: shine a light on dark money!
  • The religious right’s crusade to deregulate political spending
Granted, the group’s animus toward corporations plays into the demand for the Clinton audit, and it also highlights a problem Hillary will have if she remains in the race. Progressive populism now fuels the base of the Democratic Party, and her Wall Street connections will make it very difficult for the base to get excited about her candidacy. Progressives won’t suddenly turn Republican, but they’ll be less inclined to volunteer or turn out on Election Day. Hillary may well become the Mitt Romney of 2016.

Still, when you have groups that normally use their time stoking paranoia about ALEC and the “crusades” of the “religious right” (to end Byzantine campaign-finance reforms? Really?) making the Clintons their targets, that’s a fairly interesting development. When they end up on the same side as Ted Cruz, that’s a consensus worth noting.

i gave this a checkmark, although there is no such thing as an "independent audit", unless the IRS is involved.

auditors and tax accountants all start from a philosphy/strategy. you hire an auditor/advisor to guide you in completing your goals, with the understanding that your advisor shares the same goals, and has expertise in identifying the gray areas where the rules can be bent to get the outcomes you want.

that said, people calling for an "audit" might have one of two agendas:

1 - to put an end to the attacks on hillary, by having some reputable organization declare her "innocent", or

2 - as air cover for their abandonment of her, because they believe some inconsistencies/errors will be found (as with brian williams). NBC is using their audit of his reporting as an excuse to distance themselves from him, and get out of paying his full contract.

Actually, let's be completely honest... there's no such thing as an independent audit (the IRS has become a politically compromised organization).

But I agree with the rest...

I wonder if they got a financial statement audit. Probably very likely. And, what that audit had to say about thier internal control issues. They actually have to comment on that officially to the board and sometimes it accompanies the financials. This is a gigantic IC failure if it was accidental ( not likely) and a gigantic intentional fraud. But the audited F/S would indicate the likely hood of these problems and other IC problems found.

So, I did go look up the financials. And, indeed they were done as audits. I would be very very curious - I see that they did not include them on the page website, what the audit deficiency letters said. If you miscode millions of contributions and fail to disclose them on your TR - that is a huge IC deficiency and even though the audit is not an IC audit - that would CERATAINLY be something to comment on. HUGE - HUGE problem from an auditor perspective.

Some other interesting things.. so they changed audit firms in 2013. After a long relationship with the other firm. Also, their financials come out late. I mean LATE. Now, their 990 does not have the same March 15 deadline as other entities, so it is common to have your non-profit work be your "summer work" but, the lateness of these audit reports is fishy to me. As is the timing of the change of firms.

Also, I would just like to say, that I don't know who questioned me about the travel and travel expenses the other week and I said, they could easily claim security needs in order to fly the Clintons via charter plane. ... and low and behold... they disclosed that right there on their tax return. Furthermore, they statements clearly reference that an "allocation" is used to determine what is fundraising and admin - and what is programs. So, flying the clinton's to somewhere in the world - can EASILY be expensed as a program cost.

Additionally, I am REALLY curious about the 'in kind" donations. Anyone catch those? They black out who gave them, but listed the FMV of the services given in kind, which is basically like if I donated my tax services to a non-profit, they would claim that as an expense and in their donations - and I could get to claim it on my taxes. So, while the Clinton's did not seem to draw a salary from the consolidated entities of The Clinton Foundation ( although the report references several other entities that may not have been consolidated -for which the Clinton foundation funds) I am curious now if they are the ones who donated "like kind" services to their own foundation - thus generating a tax donation for themselves.

I really don't have time to review it in any more detail. Those are just the things that stuck out to me on my cursory review.

https://www.clintonfoundation.org/sites/default/files/clinton_foundation_report_public_11-19-14.pdf

At any rate, if I were investigating this, I would ask for communications with the audit firms. They are not privileged for one. Particularly the SAS114 and SAS 115 letter. SOMETIMES these are required to be given to an entity considering donating money or lending money, etc. So, I would be very curious if one of those suckers will leak out and what they may say about accounting irregularities happening there.

Oh and one more thing, a quick review seemed to show a loss on the fundraising programs based on the 990. They hosted some galas for MILIONS of dollars. Got MILLIONS in donations but still lost money after all was said and done - on the ones disclosed. So, imagine... you get to party with all sorts of big wigs, take in "donations" to cover it.. and then lose money to put the event on.... but hey - it was all in the name of promoting the Clintons... eh er.. the Foundation.

How much you want to bet that included somewhere on those costs are.... travel for the clintons'. Services for the clintons.. i.e. hair and make-up? What about Wardrobe services - Many people don't actually buy all their formal wear -they rent it and return it. .... I so want to get in there and dig around now.

When even the NYT and other newspapers are questioning the Clinton's propensity for ethical lapses and their unwillingness to be transparent, it means the DNC better start dusting off another candidate.

As you probably know, companies very frequently restate their financials when errors or omissions are discovered. With any large entity, even respected ones with decent internal controls, mistakes are going to be made simply based on complexity. For example Apple, one of the biggest and most most respected companies in the world, in 2006 had to restate earnings all the way back to 2002, after backdated stock-option grants were discovered. In 2013, Papa John's restated earnings back to 2009 after their auditors found an error in accounting related to a JV agreement. Deutsche Bank had to restate their 2012 financials based on having under-accounted for litigation costs. It happens. There's no reason to simply assume that every discovered error was an intentional fraud. A big entity is dealing with enough complexity that it's going to make occasional mistakes. And in the case of an entity like the Clinton Foundation, where an army of political operatives will be paid to pore over every detail of operations looking for anything with which to smear a politician whom the Republican fear, those mistakes are going to be found and trumpeted. Such is life.

Absurd. There are millions of progressives, very few of whom are stupid. Smart, inquisitive people get bored hearing the same views repeated ad nauseum, especially their own views. But typical GOP bots are neither smart nor inquisitive, and outlets of GOP hate radio therefore do quite well in the ratings.
