The 14A says birthright citizenship only applies to people born here and subject to the jurisdiction of america. And by jurisdiction they mean political (not legal) jurisdiction. Anyone born to an illegal mother inherits HER nationality and the infant is subject to her country's political jurisdiction.

I agree with you, but the SCOTUS needs to CODIFY it.

Not if the 14th is saying what the poster above says it's saying. If the SC rules that "under the jurisdiction" means what @make speed limit 45 is suggesting, then it's a done deal.

Of course Congress growing a set of balls and actually defining citizen would be optimum.

That's not the issue in the case cited in the OP article though.

I was replying to @make speed limit 45, not the OP. Either way, anchor baby is a scam.

How did things get so out of whack, the 14 amendment is clear. Maybe the lawsuit will provide the clarification.

The courts have decided they have final say on every issue. Congress can write a law saying what birthright citizenship is, but if the courts disapprove they will nullify it.

As i said earlier, the libs like to claim the word "jurisdiction" means legal jurisdiction!!! That is absurd since it's obvious our laws apply to everyone inside our borders. A foreign invader cannot murder someone and then claim he's not subject to our laws since he's not a citizen.

"Jurisdiction" in the 14A means political jurisdiction and kids born to illegals don't have that.

No, the "subject to its jurisdiction" clause is meant to exclude the children of diplomats who have diplomatic immunity.

By your interpretation, the government could as readily strip citizenship away from Black people born here by asserting that only white people are "under its political jurisdiction." In fact, they'd have legal precedent for doing so under the Dred Scott case.

It would make perfect sense to preclude happenstance birthing.... Even more so
    "Planned happenstance".
