Wow – when even the left doesn’t support Mueller, isn’t the whole case built on a house of cards?

Some excerpts from Alan Dershowitz, in the link above, regarding the dismissal of Comey by Trump:

  • Firing Comey in itself cannot be obstruction of justice because the president had the power to do so, unless there are "clearly illegal acts" and a criminal intent.
  • “You cannot charge a president with obstruction of justice for exercising his constitutional power.”

  • “Professor Dershowitz is absolutely correct: In order to make a criminal case, a prosecutor has to prove beyond a reasonable doubt that the president fired Comey with the specific intent to impede a criminal investigation,” Lauro said. “Based on what we know now, any prosecutor who brought such a charge would be laughed out of court.”

  • Professor Adam Samaha of NYU School of Law also pointed out: “If the president is acting within the scope of his exclusive constitutional authority, of course, that cannot and should not be made a crime.”

If Trump had failed to name an independent prosecutor, or named an partisan/ineffective one, there might be room for discussion. But Dershowtiz seems confident that if Mueller proceeds he "will be laughed out of court".

Wait a minute - does that end up proving that Mueller is incompetent/ineffective after all?

Comey and McCabe should have been fired on Trump's first day in office. Along with the rest of the embedded Obobo swamp dwellers in the DOJ and intelligence community.

The one real mistake I think Trump made was not doing so. The deep state actors are still taking their toll on his administration as we speak.

I agree 100%. Trump should have cleaned house completely and totally. However, I think even he didn't know how corrupt the FBI is, and to what extent the Clinton/Obama cartel had seeded it with their operatives. It's not too late, but damage has been done.

An appropriate reaction from Trump should see 30-40% of the entire FBI staff, at all levels, terminated and replaced. I suspect the rot goes at least that deep.

I don't think you can fire career FBI agents as part of housecleaning. however, if you appoint a qualified FBI director, he will select direct reports who are above reproach, and those in turn will ensure that crappy/biased agents are no longer tasked with important work they can screw up.

I can't imagine Trump - on his own - deciding to keep Comey. There was no reason to do so, and advocates from across the political spectrum who advised to let Comey go.

Thus, the question is: which Trump advisor got the presidents ear, and convinced him to keep Comey on the payroll? I doubt it was Jeff Sessions, who as head of the DOJ was Comey's immediate superior.

Trump should immediately fire everyone, in any leadership position, in the FBI and replace them with people he can trust. Then fire Mueller and prosecute Comey, Stroke(sp) and Loretta Lynch and Clinton.

I'm still curious to find out who talked trump out of firing Comey right after inauguration day. so many people wanted to see him go. at least one person who had trumps ear managed to change his mind.

The links weren't meant to explain why he'd support Trump, obviously. They were meant to show that he regularly does so. I was rebutting the idea that this was a bombshell, as opposed to just his usual pattern of behavior. The sun comes up, the sun goes down, and Alan Dershowitz goes on the usual shows to defend team Trump from an ostensibly liberal perspective. Ho hum.
