Actually Bo, as Cicero would no doubt tell you, apparently the DoJ has said that they will respond. I assume that they will essentially tell the Republican stooge judges on the Fifth Circuit that they recognize the right of the judiciary to engage in judicial review. Basically, there is no benefit to throwing the "request/order" in the circular file when it is really not that hard to accomodate the "request/order." At that point, the political stooges on the Fifth Circuit can decide whether to continue their "hissy fit/grandstanding" or they can just accept the response.
Of course, righties are going to support the hissy fits and grandstanding of Republican stooge judges. That is what righties do.
