Actually Bo, as Cicero would no doubt tell you, apparently the DoJ has said that they will respond. I assume that they will essentially tell the Republican stooge judges on the Fifth Circuit that they recognize the right of the judiciary to engage in judicial review. Basically, there is no benefit to throwing the "request/order" in the circular file when it is really not that hard to accomodate the "request/order." At that point, the political stooges on the Fifth Circuit can decide whether to continue their "hissy fit/grandstanding" or they can just accept the response.
Of course, righties are going to support the hissy fits and grandstanding of Republican stooge judges. That is what righties do.

Cicero's hangin' with his "belly crawl" allusion, even as the fact remains that this Judge lacked the authority to enforce his demand. Therefore, ObamaJustice "chose" to play along with the Judge. It will be interesting now, to learn of the specifics.
Obama Justice didn't decide to play along. As soon as Holder/Obama cleaned out their pants, they belly-crawled over to the 5th Circuit and presented their, SORRY, we f**ked up and let our elephant mouths overload our hummingbird asses.

Secondly - the order is not one this Justice has the authority to enforce by himself

Yup. Submitting such an explanation isn't a belly crawl. Simply becuse the Reagan hack decided to be a politician doesn't mean that submitting it is a belly crawl. And that his is overreach by the judge is hardly of any question.

And basically this is why the GOP is going to lose in the fall. Because your ideology and irrational (read racial) hatred of Obama makes it impossible for you to read the politics of the situation accurately and thus you celebrate the overplaying of hands like this one.
This judge - a Reagan appointee at age 66 - basically an Old White Guy - reaches outside of his immediate case, inserts himself into the healthcare debate in a purely partisan manner, and you consider this a "belly crawl" when the WH basically tells him - "here have a boilerplate answer".
Sorry that plays really poorly with pretty much everyone except... Old White Guys... like you. And that's a demographic that Obama lost in 2008 and really doesn't give a sh!t about.
