Yes and constitution grants Congress the power to check the executive's power completely independent of the judiciary.

Congress has the authority to issue subpoenas to member of the executive branch.

The GOP in Benghazi issue subpoena like they were handing out candy.

Not once did they ever say their subpoenas needed to be validated by a court before they had to be honored.

Courts don’t impeach, the Congress can.

But in questions of privilege, the courts must decide who or what constitutes privileged status. The Congress does not and cannot do it. They simply don’t have the authority or the means to coerce the executive to comply.

They do have the consitutional authority that doesn't require the require the courts consent.
They can:
1) arrest for contempt of Congress which doesn't require the courts approval
Or
2.) Impeach them, which doesn't require the courts approval.
