Should Boehner and his crew be arrested for undermining Obama's foreign policy?

Boehner's decision to conspire with Netanyahu to undermine Obama's diplomatic initiatives with Iraq could lead to Boehner spending time in the pokey, no?

The Logan Act.....

The Logan Act (18 U.S.C.A. § 953 [1948]) is a single federal statute making it a crime for a citizen to confer with foreign governments against the interests of the United States. Specifically, it prohibits citizens from negotiating with other nations on behalf of the United States without authorization.

Sheesh, that's exactly what Boehner and his fellow haters are trying to do, no? What possible defense would he have to prosecution under the statute?

Here's how it reads.....

Any citizen of the United States, wherever he may be, who, without authority of the United States, directly or indirectly commences or carries on any correspondence or intercourse with any foreign government or any officer or agent thereof, with intent to influence the measures or conduct of any foreign government or of any officer or agent thereof, in relation to any disputes or controversies with the United States, or to defeat the measures of the United States, shall be fined under this title or imprisoned not more than three years, or both.

This section shall not abridge the right of a citizen to apply, himself or his agent, to any foreign government or the agents thereof for redress of any injury which he may have sustained from such government or any of its agents or subjects.

White House spokesman Josh Earnest said, "The protocol would suggest that the leader of one country would contact the leader of another country when he's traveling there. This particular event seems to be a departure from that protocol."

Asked by a reporter if inviting Netanyahu without speaking to the White House was a "poke in the eye" to Obama, Boehner, a Republican, said, "The Congress can make this decision on its own. I don't believe I’m poking anyone in the eye."

I'm not even talking about protocol - that's a whole different disgrace. Netanyahu didn't even talk to the White House first. It's a complete end-around attempt, and Boehner was only too happy to help a foreign leader undermine the US president.

But that's just protocol - not a crime, just disgraceful conduct. My post here goes to the question of whether Boehner is violating the law - the Logan Act. Can you think of any defense he might have after reading the Act?

Logan wasn't IN Congress. It was Congress that went after him. He was considered an "unauthorized citizen". Boehner is NOT violating the law.

In general, the Act is intended to prohibit American citizens without authority from interfering in relations between the United States and foreign governments. Although attempts have been made to repeal the Act, it remains law and at least a potential sanction to be used against anyone who without authority interferes in the foreign relations of the United States.

No. They should be praised for attempting to clean up the mess Obama made, stepping in to maintain diplomatic relations with our key ally in the middle east, a task Obama was incapable of performing, likely due to his anti-Semitism.

No, not unless they arrest Obama for usurping power not his. There are 3 equal branches of government, Boehner has all the right to invite who he wants.

You forget....the speaker of the house has his own particular realm of authority. The President is not the totality of American Authority and was never supposed to be.

The three branches of government are separate and equal. Obama thinks he's King. The Boehner move might put him in his place, but I doubt it. Obama doesn't even realize that the Republicans smeared his policies that were in every election this past November (according to Obama himself).

No. They should be praised for attempting to clean up the mess Obama made, stepping in to maintain diplomatic relations with our key ally in the middle east, a task Obama was incapable of performing, likely due to his anti-Semitism.
Your statutory analysis of the Logan Act was a tad lacking there.

That is not happening, besides inviting a foreign leader to address Congress is NOT a violation of the Logan Act.

Also, I think it would be news for most to discover this President actually had a foreign policy to undermine.
