Because the dividends that Romney and everyone else who has capital gains are net, not gross.

Those dividends are paid on profits that are already taxed at the 36% corporate rate, which means if their was no corporate income tax the dividends would be 36% higher.

Then after you receive the dividend you have to pay an additional 15% rate, in essence bringing the total tax payed to over 50%.

Romney donated over 40% of his income to charity, so he got to write that off, bringing his dividend tax rate down to 13.9% which means that had an effective tax rate of 49.9%.
