The repubs will argue that the Senate was not in recess, but that isn't true. The constitution does not specify how long the president has to wait after the gavel ends the session before he can make an appointment. While custom may hold that it is three days, the fact is that two minutes after the session ends (and then they are in recess) the president can make his appointment.
