US government to cancel medicine patents, seize and nationalize them as its own assets?

Rebuild With Biden!
Biden is acting out of fear of an electorate which must be given some kind of concrete progress to keep them voting to keep him and his allies in power.
Biden has made solid/concrete progress in many ways.., His latest proposal should make the pharmaceutical companies stay on their toes and make their drug prices more reasonable to the consumers.
Many are now getting their insulin much cheaper these days, thanks to Biden/admin.

New HHS Report Finds Major Savings for Americans Who Use Insulin Thanks to President Biden’s Inflation Reduction Act

$35 monthly insulin cap in historic law, which went into effect January 1 for Medicare Part D, would have saved 1.5 million people with Medicare an average of $500 dollars on their insulin in 2020

Today, the U.S. Department of Health and Human Services (HHS) issued a new report showing the major savings coming to people with Medicare thanks to the $35 cap on a month’s supply of insulin. The report shows that if the Inflation Reduction Act’s provision capping the cost of insulin at $35 for a month’s supply for Medicare beneficiaries had been in place in 2020, 1.5 million seniors across the country would have saved an average of $500 on insulin for the year. Through the Inflation Reduction Act – the most consequential health care law since the Affordable Care Act – President Biden is delivering on his promise to lower prescription drug costs, make health insurance more affordable, and make the economy work for working families.

The insulin provisions of this historic law went into effect January 1, 2023, for Medicare Part D. Starting July 1, 2023, under Medicare Part B, beneficiary cost sharing will be limited to $35 for a month’s supply of insulin. Researchers estimate that 1.5 million people with Medicare would have benefited from the new Inflation Reduction Act insulin cost-sharing limits if they had been in effect in 2020, with total savings to beneficiaries of about $734 million in Part D and $27 million in Part B – an average savings of approximately $500 for those Medicare beneficiaries.

“The Biden-Harris Administration is committed to lowering health care costs and increasing access to high-quality, affordable health care, and the Inflation Reduction Act is helping us do just that,” said HHS Secretary Xavier Becerra. “Thanks to this historic law, people who get their insulin through Medicare won’t have to pay more than $35 for a month’s supply. No one should have to skip or ration their insulin because they can’t afford it.”

Ameet Sarpatwari, assistant director of the Program on Regulation, Therapeutics and Law at Harvard Medical School, said that while "march-in" sounds militant and like the government is stealing something, it's not the case at all.

"There is nothing that is being stolen. There is nothing that is being seized," he said. "This is the government exercising its rights on a voluntary agreement that a private company [or university] has entered into with the federal government by accepting funding for research."

The proposed framework clarifies that this existing authority can be used if a government-funded drug's price is too high, something the National Institutes of Health has declined to exercise for many years.

With the new proposal, it's no longer a dormant government power, Sarpatwari said.

I'm aware that happens to some unless they're on Medicaid
I have a friend that takes a $1000 pill Daily and his wifes gov insurance pays for it
I'm also aware if they are dying the med just prolongs death a bit but doesn't end the hellish pain and misery they are living with

I had a friend I've known since grade school die yesterday due to Agent Orange and the expensive meds didn't stop his death

The only things Biden has solid/conrete progress on is $132Billion in Unconstitutional student loan forgiveness and the cost of living out of reach for many with his green agenda thats as useless as teets on bore hogs.

Photo above - Candidate Biden in 2020 promises to cancel student loans, trying to lock up the youth vote. In 2024 he's promising to cancel drug patents and have the government hand out discount medicines.

Wow, nationalize medicine production? This HAS to be an article about some place like Venezuela, right? The country that just voted to invade next-door neighbor Guyana, and steal its oil? Nope . . . I re-read the article. It's definitely the USA. See the link at the bottom.

Nationalization is straight out of Marxist theory 101. Here's an actual quote from Karl Marx: "Loot the looters!" ("грабь награбленное"), which was a rallying cry during Russia's 1917 October Revolution. More recently, 21st century socialists have argued that nationalization is the easiest first step to transition from a free-market economy to socialism. All this stuff is on Wikipedia. You can look it up - I don't need to provide 10 different links.

The promise to nationalize the patents on all our most important medical discoveries DOES NOT appear to be “make way for socialism, comrade”. It's something simpler, but even more alarming: “Keep our party in power, comrade!”

Promising the nationalization of miracle drugs is EXACTY the same as promising to forgive all student debt in 2020 (or build a border wall in 2016, for that matter). Shouting about drug nationalization is a transparent attempt to sway voters and hold onto power. Buying votes like this explains why America's national debt is $33 trillion and still skyrocketing. There are SO MANY special interest groups whose votes can be bought by flashing a roll of cash: Student debtors; EV car fans; factory workers dependent on defense contracts; farmers with more crops than legitimate buyers. The list is endless. You know this is true.

So . . . all this drug nationalization campaign-shouting is on even shakier ground than Student Loan forgiveness promises in 2020. That stuff wound up in court and is still being litigated. I seriously doubt if Team Biden is going to even attempt to take their patent seizure scheme to court between now and November 5th, 2024. They'll just talk about it, and try to make the minority party look like villains for pointing out the legal flaws.

There's actually a decades old law from the 1900's which the Biden administration CLAIMS allows a president to seize drug patents. But that law has never been used. Under the Bayh-Dole Act of 1980 "the government retains certain rights on any products produced through a public-private partnership using federal funding . . this legislation allows federal agencies that provided the funding to compel companies to provide a “nonexclusive, partially exclusive, or exclusive” license to a “responsible applicant.”

As you can see, this decades old legislation doesn't specifically refer to pharmaceutical makers which accepted federal grants to develop essential medicines. The wording might just as easily apply to colleges (Harvard); automakers (General Motors); chip makers; electric power plants, oil companies, hospitals, farms receiving price supports, airlines . . . In fact, you EVER took a dollar from the government, your business might be construed as falling into the nationalization category by the president. If there's a constitutional law expert in this forum, please weigh in here.

This is certainly not what the sponsoring Senator Bob Dole (1923-2021) ever intended. The wording he drafted is much narrower: the government can compel a company with federal funding to allow "responsible applicants" to cross-manufacture. The law doesn't assert that the government can unilaterally declare those patents its own property. Whether it's a tough re-election fight, or otherwise.

But I don't think we have much to worry about here. This is such an obvious political stunt that it won't ever make it to the Supreme Court. And I fully anticipate Biden will soon be telling us in a follow up press conference that “I wouldn't even be nationalizing our drug patents – or seeking re-election at all - if Trump wasn't running.” Stop laughing. You KNOW this is going to happen.

I'm just sayin' . . .

Targeting costly meds, Biden admin asserts authority to seize certain drug patents - POLITICO
Greedy Pharmaceutical companies who use billions in US grants to develop drugs should be prevented from endlessly price gouging US Citizens on life saving drugs. What is really disgusting is that these ass holes often sell these US funded drugs to foreign countries for much less than they sell them to US Citizens. The shady interactions between pharma lobbyists and US elected officials should be brought to a screeching halt. Seems like big pharma owns a large percentages of Congress and the Senate these days. Huge conflict of interest in my book.

actually they do . .. they've borrowed $33 trillion from other nations, by printing promissory notes called "Treasury Bills". There are only two paths out of this mess. Raise taxes (on us or our kids). Or default, and become globally irrelevant.
The national debt is mostly from SS

you state the obvious. good job! now tell me about the legitimate, pre-agreed to contract on pricing and ownership of those patents, between Pfizer, Moderna, and the US government. Go on and do some research. The rest of us can wait while you come up to speed.
Corruptly giving the national patrimony to oligarchs is not a legitimate function of government.

if someone wants a piece of the pie, negotiate the size of that piece while the pie is being baked. don't try to steal the whole pie once it comes out of the oven, because you contributed a few eggs.
A better analogy would be that the American people contributed all the eggs, flour, sugar, butter, and labor, while the pharma companies graciously allowed the pie to be baked in the kitchen which we also constructed for them.

The reason for drug shortages is much more complicated than placing the blame on Biden.
When a big name patent drug eventually becomes a generic, the generics are lots cheaper, and less money is to be made off them. So, manufacturers aren't that interested in making them.

Then as ASOT mentioned foreign countries manufacture lots of generics they have less quality control than the USA, inferior maybe but producing cheaper drugs.
Interesting video on the link.

Specialty drugs come with a hefty price tag.
They can work miracles it would be the greatest thing ever if they could be given to everyone needing them regardless of the price.

Sorry for the loss of your longtime friend, Dawg.

Again...the government will not be taking over production of drugs. They will license other manufacturers to use the patents.

Look into the cost of insulin, some time.

Wondering if anyone watched NBC Nighty News and the story of Conterfit Meds?
Appears people on AID buying a $1000 script are selling them for #100/$200 and the criminals are washing patients into all the bottle and relabeling them and selling them to local pharmas at a bargain and some bottles meds were switched or even had rocks replacing the meds. this was in Cali but when I searched this has been going down for a hell of many yearsm a $230Billion case in Florida, hellfire, it's going down all across America/
Evidently Joey is looking in all the wrong places form criminals. BTW: the biggest seller appears to be HIV meds!

ASOT put your magic on this if ya will, thx
