You probably remember Jessica Ghawi, the aspiring sportscaster who James Holmes shot and killed. Well, her parents sued the ammo manufacturers who mail ordered him thousands of rounds.

The judge tossed it.

But losing a daughter and the lawsuit wasn't enough. Looks like they'll have to pay around a quarter million for the bullet boys' legal fees. Really ...

There was no basis for holding them legally responsible. Frivolous lawsuits trying to make a name for the attorney's come with costs. HOPEFULLY they can make their own lawyers who should have advised the this will get tossed pay it.

Wow.. you didn't even make it to "Peeved" eh? Ok, but i find this story really sad. Thanks NRA for the Colorado law that protected your overlords. :rolleyes:



 
this guy (the judge) was born in 1930. he's now 85 years old.

isn't there some sort of statute of limitation on how long you can serve?

once again, the public's demand for term limits is rebuffed.

It is a really sad case. What is really sad is that a person like James Holmes was not forcibly admitted to treatment long before he could massacre all those people including their daughter.

BUT - it doesn't make the ammo manufacturer liable. And, I am appalled and disgusted at people using our legal system to "make statements" etc. That is not the place for it. And, its an abuse of the system to be honest. And, I do not think that we should in any way encourage people to file lawsuits they have no chance of winning just to make a point. And, if making them pay the fees of those whose money the waste is teh way to do that. Fine with me. No matter how tragic the circumstance.

While i understand your point and while the Ghawi's attorney probably should have advised them against bringing the case, mail order bullets in these kinds of quantities should be outlawed.

Fine, but that is completely different than suing them after the fact for something that is legal. I despise judicial activisim. I despise abusing the courts in that manner. And, it doesn't matter how tragic your story is - you do not get to rewrite the law by filing frivolous claims tying up resources and using other's money to do so.

I have no love for the NRA or ammo manufacturers and don't even own a gun. But, I have a strong abhorrence to using the courts for your own purposes. And, I do not feel bad they got slapped for their over-reach. Hopefully it will make others think twice.

The real problem is the federal and state laws that immunize gun dealers and ammo dealers from any lawsuits, and that further provide that anyone daring to sue those merchants of death must pay their legal fees.

Such blanket immunity is reserved for gun and anmo dealers. Gun and ammo dealers have this nation in a stranglehold.

That asked, I'd like to remind you that it's usually the Left who reminds people that "The Law" is "The Law", and must be strictly adhered to. In fact, the Left has never met a new law it didn't like. What happened here?

Only a prepper or murderous madman would buy 175 pounds of ammo. One look in Holmes eyes and a lot of ammo dealers probably would have refused to sell. Hell, what's to keep a 10 year old from building that kind of arsenal?
